Legal Consequences of Drunk Driving and Alcohol-Related Violence

Drunk driving and alcohol-related violence continue to be among the most serious public safety concerns in India. With the introduction of the new criminal laws—Bharatiya Nyaya Sanhita (BNS), 2023, Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 and Bharatiya Sakshya Adhiniyam (BSA), 2023, the legal framework for dealing with such type of offences has become stricter, more structured and more victim-oriented.

Driving under the influence not only risks the life of the driver but also endangers pedestrians, commuters and the entire road ecosystem. Understanding the legal consequences is crucial to prevent such type of offences and promote responsible behaviour on the road.

Understanding Drunk Driving Under Indian Law

Drunk driving is primarily governed by the Motor Vehicles Act, 1988, which clearly prohibits operating a vehicle with a blood alcohol content (BAC) higher than the prescribed limit.

The permissible limit in India is:

  • 0.03% BAC or 30 mg of alcohol per 100 ml of blood.
  • If a driver fails a breathalyser test, refuses testing or behaves suspiciously, police can take legal action immediately.

Legal Provisions for Drunk Driving (Motor Vehicles Act, 1988)

1. First Offence – Section 185 (MV Act)

  • Fine up to ₹10,000
  • Imprisonment up to 6 months, or both
  • Licence may be seized or suspended

2. Second/Subsequent Offence

  • Fine up to ₹15,000
  • Imprisonment up to 2 years, or both
  • Higher chances of licence cancellation

3. Refusal to Cooperate with Police

Refusing a breath test or medical examination can be treated as obstruction and lead to legal action, including arrest.

Drunk Driving Resulting in Injury or Death (Updated with New Criminal Laws – BNS 2023)

While the Motor Vehicles Act covers basic penalties, serious accidents caused due to drunk driving are punished under the Bharatiya Nyaya Sanhita (BNS), 2023.

1. Rash or Negligent Driving Causing Injury – Section 281 (BNS): -

  • Imprisonment up to 6 months
  • Fine up to ₹5,000, or both

2. Rash and Negligent Driving Causing Death – Section 104 (BNS): -

(Previously Section 304A of IPC)

  • Imprisonment up to 5 years
  • Fine (court-determined)
  • Applicable regardless of intention

3. Causing Death by Rash Driving Under Aggravating Factors – Section 105 (BNS): -

This section applies when:

  • The driver was drunk
  • Driving at excessive speed
  • Driving dangerously or aggressively

Penalty:

  • Maximum imprisonment: 10 years
  • Fine (as decided by the court)

This is the most serious provision for drunk-driving accidents and reflects the tighter stance under new criminal laws.

Alcohol-Related Violence 

Alcohol consumption is also a major trigger for violent behaviour, including assaults, domestic disputes and public disturbances. The BNS provides stringent punishment for such offences.

1. Voluntarily Causing Hurt – Section 115 (BNS)

(Equivalent to IPC 323)

  • Imprisonment up to 1 year
  • Fine up to ₹10,000, or both

2. Voluntarily Causing Grievous Hurt – Section 117 (BNS)

(Equivalent to IPC 325)

  • Imprisonment up to 7 years
  • Fine

3. Wrongful Restraint or Intimidation – Sections 138, 140 (BNS)

  • Jail up to 1 year
  • Fine up to ₹5,000, or both

4. Public Disorder or Harmful Conduct – Section 255 (BNS)

For riots, group violence, or violent public behaviour: -

  • Imprisonment up to 3 years
  • Fine
  • Additional penalties for unlawful assemblies

Alcohol-induced violence is treated seriously, especially when it threatens public peace or injures others.

Additional Consequences of Drunk Driving in India

1. Licence Suspension or Cancellation

Depending on the severity of the offence, the RTO may: -

  • Suspend licence for 3–6 months
  • Cancel licence permanently (in repeated or grave offences)

2. Higher Insurance Premiums or Claim Rejection

In drunk driving cases: -

  • Insurance companies may deny claims
  • Premiums may significantly increase

3. Criminal Record Under BNS

A conviction under Sections 104 or 105 of BNS leads to a permanent criminal record, affecting future employment, visas and background checks.

4. Vehicle Impoundment

Police may seize the vehicle of a drunk driver, especially in repeat cases or those involving injuries.

The newly introduced criminal laws emphasize:

  • Victim protection
  • Deterrence through higher punishments
  • Faster investigation and trial
  • Accountability in reckless and drunken behaviour

The government’s aim is to reduce road fatalities and create safer public environments.

How to Stay Safe and Avoid Legal Trouble?

  • Prefer cabs, taxis or app-based rides after drinking
  • Never drive “just a short distance” when not sober
  • Use breath-check devices to monitor the amount of BAC
  • Friends should prevent each other from driving after alcohol
  • Understand the seriousness of legal penalties
